1. Introduction

These Terms of Service and Website Terms of Use (“Terms”) apply to your use of the CA Flourish Psychology website and to any psychological services provided by us. Together they explain how CA Flourish Psychology operates, what you can expect when you engage our services or visit our website, and your rights and responsibilities as a user and prospective client.

When we say “you” or “your”, we mean you as an individual client or website user.
When we say “we”“us”, or “our”, we mean CA Flourish Psychology (ABN 15 729 237 589).

By accessing our website or engaging our services, you agree to these Terms, together with our Privacy Policy and Cancellation Policy (both available on our website). If you do not agree, please do not use our website or services.

Nothing in these Terms is intended to limit your rights under Australian law, including the Australian Consumer Law.

2. Important Disclosures

Please note that:

·       our services do not provide crisis or emergency support; if you require immediate assistance, please contact emergency services 000 or Lifeline (13 11 14);

·       psychological services require your active participation and informed consent;

·       clause 12 (Liability) outlines limits on our legal responsibility, to the extent permitted by law.

3. Engagement & Therapeutic Relationship

3.1 These Terms apply from the earlier of:

·       the date you book or attend your first appointment; or

·       the date you otherwise engage with our services.

3.2 A psychologist–client relationship is established only when services are formally commenced, not by visiting our website or making an enquiry.

3.3 Psychological services are provided in accordance with:

·       the Psychology Board of Australia Registration Standards;

·       the APS Code of Ethics; and

·       applicable laws and professional guidelines.

4. Psychological Services

4.1 Services include psychological assessment, therapy, consultations, and related mental health services as agreed with you.

4.2 Services are provided with reasonable care and skill, and in a manner that is ethical, evidence-informed, and respectful of your dignity, autonomy, and cultural background.

4.3 We may be unable to provide services where:

·       you require immediate crisis or emergency intervention;

·       you attend sessions under the influence of alcohol or drugs;

·       there is a significant risk of harm to yourself or others and appropriate external supports are not in place; or

·       you are located outside Australia and we are unable to provide service due to registration or insurance restrictions.

5. Your Rights as a Client

You have the right to:

·       receive services in a safe, respectful, and non-discriminatory environment;

·       be informed about the nature, purpose, risks, and alternatives to services;

·       ask questions and provide or withdraw informed consent;

·       understand fees and billing arrangements; and

·       discontinue therapy at any time.

If you have concerns:

·       please raise them with us directly in the first instance;

·       if you are not satisfied with our response, you may refer the matter to AHPRA.

6. Your Responsibilities

You agree to:

·       comply with these Terms and all applicable Laws;

·       attend appointments on time and provide appropriate notice of cancellation in respect to our Cancellation Policy;

·       provide accurate and relevant information to support safe and effective care;

·       engage respectfully with your psychologist and staff; and

·       ensure valid referrals and Mental Health Care Plans where Medicare rebates are sought.

If you are under 18 or lack decision-making capacity, consent must be provided by a parent or legal guardian.

7. Mandatory Reporting & Duty of Care

You acknowledge that we may be legally required to disclose information where:

·       there is a serious risk of harm to you or others;

·       child abuse or neglect is suspected; or

·       disclosure is otherwise required by law.

Where possible, we aim to discuss such disclosures with you beforehand.

8. Mental Health Care Plans & Medicare

8.1 If accessing Medicare rebates, you must provide a current Mental Health Care Plan and referral before your appointment.

8.2 We are required to provide progress reports to your referring practitioner in accordance with Medicare rules.

8.3 Failure to provide a valid plan may result in you being charged the full fee without rebate.

9. Medicare & Third-Party Consents

You authorise us (and our authorised service providers) to:

·       submit Medicare claims on your behalf for eligible services provided to you;

·       access relevant Medicare records for billing purposes; and

·       communicate with Medicare regarding your eligibility and claims.

You may withdraw this consent in writing, noting this may affect rebates.

10. Fees, Payments & Cancellations

10.1 Fees are communicated prior to service and are payable on the day of your appointment unless otherwise agreed.

10.2 Cancellations
You must provide at least 24 hours’ notice to cancel or reschedule an appointment either via phone, email or through our online booking system.

Late cancellations or non-attendance may incur the full fee, as outlined in our Cancellation Policy. In cases of genuine emergency, fees may be waived at our discretion.

10.3 Fees are not refundable for services already provided.

10.4 If fees remain unpaid in accordance with the Payment Terms, we may, after reasonable notice and subject to your rights under Australian law, suspend or end Services until payment is made. We may also recover reasonable costs associated with the collection of overdue amounts.

Interest may be applied to overdue fees at the Reserve Bank of Australia cash rate plus 2% per annum, calculated daily and compounded monthly, from the due date until payment is received.

11. Privacy & Confidentiality

11.1 We handle personal information in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles.

11.2 Confidentiality is central to psychological practice, subject to legal and ethical limits (including mandatory reporting).

12. Liability

12.1 To the extent permitted by law and subject to your Consumer Law rights:

·       we are not liable for indirect or consequential loss; and

·       our liability is limited to the fees paid for the relevant service.

12.2 Nothing in these Terms excludes liability for matters that cannot lawfully be excluded.

12.3 This clause 12 will survive the termination or expiry of these Terms.

13. Ending Therapy

13.1 You may discontinue therapy at any time.

13.2 We may end or pause services where:

·       continuing therapy is no longer clinically appropriate;

·       there are unresolved safety or boundary concerns; or

·       required fees remain unpaid.

13.3 Where appropriate, we will aim to discuss endings respectfully and support referrals to alternative services.

14. Using This Website

This website is provided for general information about our services and how to contact us.

You agree to use this website:

·       for lawful purposes only; and

·       in a way that does not interfere with its operation or security.

You must not attempt access to any systems or content that you are not authorised to access.

15. General Information & Limitations

Information on this website:

·       is general in nature only;

·       does not replace professional psychological assessment or treatment;

·       does not establish a psychologist–client relationship; and

·       should not be used for self-diagnosis or clinical decision-making.

We may update website content at any time and do not guarantee accuracy or completeness.

16. Governing Law

These Terms are governed by the laws of South Australia, and the courts of South Australia have exclusive jurisdiction.

Definitions

In these Terms, unless the context otherwise requires:

AHPRA means the Australian Health Practitioner Regulation Agency.

APS Code of Ethics means the Australian Psychological Society Code of Ethics (2018) and any amendments or replacements.

Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Business Day means a day other than a Saturday, Sunday, or public holiday in South Australia.

Fees means the fees payable for the Services, as communicated to you prior to your appointment, displayed on our website, or otherwise agreed with you.

Medicare means the Australian Government Medicare scheme administered by Services Australia.

Mental Health Care Plan means a plan prepared by a registered medical practitioner in accordance with Medicare requirements, enabling access to Medicare-subsidised psychological services.

Personal Information has the meaning given in the Privacy Act 1988 (Cth), and includes health information.

Privacy Policy means our privacy policy, available on our website, as updated from time to time.

Services means the psychological services provided by CA Flourish Psychology, including assessment, therapy, consultations, and related mental health services.

Terms means these Terms of Service and Website Terms of Use, together with any documents incorporated by reference (including our Privacy Policy and Cancellation Policy).

Website means the CA Flourish Psychology website located at www.caflourishpsychology.com.au and any associated webpages.
